Barrows and TMZ are disputing the nature of the allegations. Barrows is essentially a 49ers mouthpiece. We've ridiculed his credibility in other instances. TMZ is... well, TMZ.

So, basically, nothing solid right now other than there is an allegation against Kaepernick (confirmed by Miami PD).

OK that's total BS. He's a beat writer with the 49ers and one of the best ones out there. He and Maiocco are the best.

There is NO allegation BTW. The police report states specifically that they DID NOT have sex and it was a woman that had a previous relationship with him.

The suspicious incident is that she passed out and didn't know how she got to the hospital. In fact, in reading the report there is nothing that makes Kap more "at fault" than Patton or Lockette.

Also funny that you are attacking TMZ for disputing the allegations when they were the ones who reported it. LOL.

Strictly speaking, the report says that they did not have sex during the part in the evening that she remembers. It does not rule out any sexual contact that night, at least not what we have heard so far.

Lots of questions left to be answered, that's for sure.

Kap is simply getting grandstanded because he is the most well known player in this situation. You don't see the headlines mentioning the bong in Lockette's apartment which would definately be the case if it was Kap's apartment. It's starting to actually look like Kap decided not to have sex with her (who he already had sex with before) because she was too wasted. So the possibility is that he, our somebody in the group, took her to the hospital because she partied too hard instead of having sex with her.

IMO, it's funny that Barrows left out the part about Kap undressing and kissing the accuser when he "summarized" the police report. Why did he feel that wasn't worth reporting?

Right...he left THAT out but included the Marijuana because its his goal to be the "mouthpiece of the 49ers". LOL.

In fact, the woman didn't resist having sex with him and asked where he went. Then she stated implicitly that they DID NOT HAVE SEX.

What's suspicious is why did she pass out, why doesn't she remember, and why was she in the hospital.

Doesn't seem to make sense that they'd rape her and then take her to a place that could run a rape kit and find out who did it.

Honestly does it really matter that much. he was in there with her. He didn't forcibly take off her clothes and he left the room without having sex when he could have. When the other two looked in the room, she asked where he was.

I'm not saying he is guilty of any wrongdoing. A lot of this suggests that he isn't. I just take issue with your comment that Patton and Lockette are equally "at fault" based on the police report. They didn't touch her according to the accusations.

10:32 AM PT -- According to the police report, the accuser told cops she went to Lockette's apartment around 9pm on April 1 and saw Kaepernick and Patton.

The woman says she mixed some drinks for the guys and gave them shots, but they told her that "in order to drink the shots she had to 'hit' the bong which contained marijuana."

The woman says she felt lightheaded and went to the bedroom to lie down. She claims Kaepernick "came up behind her into the bedroom and started kissing her."

"She advised they were kissing (mouth) and Mr Kaepernick started to undressed [sic] her. She got completely naked. Mr. Kaepernick told her that he was going to be right back and left the bedroom. They did not have sex."

The woman told cops that while she was still naked in bed, Patton and Lockette opened the door and "peeked" inside. She says she told them to get out ... but she can't remember anything after that.

The woman later woke up in a hospital bed ... but says she doesn't remember how she got there or who took her there.

The woman also claims she has had a sexual relationship with Kaepernick in the past.

Right...but she isn't having an issue with his touching of her. Her issue is blacking out and not knowing how she got to the hospital. She stated they DID NOT have sex.
